Terms of Use

1. Acceptance of Terms

By downloading, installing, accessing, or using any Guinto Tech mobile application (the "Apps"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with these terms, you must not access or use the Apps.

2. Eligibility and Accounts

You must be of legal age in your jurisdiction or have the consent of a parent or legal guardian to use our Apps. Some Apps may require you to create an account or provide personal information as described in our Privacy Policy. Other Apps — such as Streak Fast, which is fully serverless and uses Apple CloudKit — do not require accounts, logins, or registration of any kind. Pūteaflow is offered to residents of New Zealand and requires you to grant an Akahu open-banking consent when you first connect a bank; that connection is governed by Akahu's own terms (see Section 6 and the Pūteaflow notice below).

Where an App does require an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to notify us immediately if you become aware of any unauthorized use of your account. We reserve the right to suspend or terminate your access if we believe your account has been compromised or you have violated these Terms.

3. Permitted Use

The Apps are provided for your personal or internal business use. You agree not to:

• Reverse engineer, decompile, or disassemble the Apps except where permitted by law
• Use the Apps for any unlawful purpose or in violation of applicable regulations
• Interfere with or disrupt the security, integrity, or performance of the Apps
• Upload or transmit harmful code, unauthorized data, or infringing content
• Use automated systems to extract data or abuse rate limits

4. Intellectual Property

All content, trademarks, logos, user interface elements, and technology within the Apps are owned by or licensed to Guinto Tech and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Apps in accordance with these Terms. No other rights are granted unless explicitly stated.

5. Purchases, Subscriptions, and Payments

Some Apps offer optional paid features or subscriptions processed through third-party app stores or payment providers. All payment transactions are subject to the terms and policies of those third parties. It is your responsibility to manage subscriptions or request refunds through the applicable platform, where permitted.

Pūteaflow specifically offers a 7-day free trial via Apple's StoreKit, after which an auto-renewing subscription is required to continue using bank-connected features. You can manage or cancel from your Apple ID Subscriptions screen at any time.

We may change pricing, introduce new features, or discontinue paid offerings with prior notice through the Apps, app stores, or associated communications.

6. Third-Party Services and Content

Our Apps may integrate third-party services (such as analytics, authentication, or cloud storage) or provide links to third-party content. These services are governed by their own terms and policies. We are not responsible for third-party offerings, and you use them at your own risk. We encourage you to review the privacy and terms documentation of any third-party service you choose to use through our Apps.

7. Privacy and Data Handling

Our handling of personal information is described in detail in our Privacy Policy. By using the Apps, you acknowledge that we will collect, use, and share data as outlined there, including information about device usage, analytics, crash reports, and any personal data you provide. We implement safeguards to protect your information and work only with partners that share our commitment to privacy.

Some of our Apps — including Streak Fast — are built as 100% serverless native iOS apps using Apple CloudKit. For those Apps, Guinto Tech does not collect or store any of your personal data on our servers; all data remains on your device and within your own private iCloud account. Your use of iCloud is governed by Apple's terms and privacy policy.

8. Termination

We may suspend or terminate your access to the Apps at any time if you violate these Terms, misuse the Apps, or if it is required to comply with legal obligations. You may also stop using the Apps at any time by uninstalling them or closing your account where applicable.

Upon termination, your right to use the Apps will immediately cease. Sections that by their nature should survive termination will continue to apply, including ownership, warranty disclaimers, limitations of liability, and dispute provisions.

9. Disclaimers

The Apps are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Apps will be uninterrupted, error-free, or secure, nor that any defects will be corrected. Your use of the Apps is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by law, Guinto Tech, Guinto Limited, and their directors, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Apps. Our total liability for any claim shall not exceed the amount you paid (if any) to access the specific App during the twelve (12) months prior to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Guinto Tech, Guinto Limited, and their affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Apps, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms are governed by the laws of New Zealand, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in New Zealand to resolve any legal matter arising from the Terms or your use of the Apps.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Apps, legal requirements, or business practices. When we make changes, we will update the effective date at the top of this page and, when appropriate, provide additional notice through the Apps or other communication channels.

Continued use of the Apps after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Apps.
